These Terms & Conditions (“Terms”) govern access to and use of the website operated by Positive Me (“we,” “us,” “our”) and any purchase made through the website (the “Site”).

2. Scope & Acceptance

By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, you must not use the Site.

These Terms apply to:

  • Consumers (B2C), and

  • Business customers (B2B), subject to Section 18.

Additional policies referenced herein form part of these Terms. Lists of obligations, rights, or examples under these Terms are explicit but not limited to those described.

3. Eligibility & Age

You must be at least 18 years old (or the age of majority in your jurisdiction) to place an order. If you are under 18, a parent or legal guardian must place the order and accept these Terms.

4. Accounts

You may shop as a guest or create an account. You are responsible for:

  • Providing accurate and current information

  • Maintaining the confidentiality of your login credentials

  • All activity under your account

We may suspend or terminate accounts for misuse, fraud, or breach of these Terms.

5. Products & Information Accuracy

We strive to display products as accurately as possible. However:

  • Colors may vary depending on screen and device settings

  • Measurements and fit guidance are approximate

  • Minor variations may occur due to production processes

All products are subject to availability. We reserve the right to limit quantities or refuse orders at our discretion.

6. Pricing, Currency, Taxes & Duties

  • Prices on the international Site are shown in USD, unless stated otherwise.

  • Prices may change at any time but will not affect accepted orders.

  • Shipping fees and applicable charges are displayed at checkout.

Import taxes, customs duties, and handling fees may apply depending on the destination. Unless explicitly stated otherwise, these charges are the responsibility of the customer and are non-refundable if a shipment is refused or unclaimed.

7. Orders & Contract Formation

Your order constitutes an offer to purchase. A binding contract is formed only when we accept the order and issue an order confirmation or dispatch the products.

We reserve the right to refuse or cancel orders due to reasons explicit but not limited to:

  • Payment authorization issues

  • Pricing or listing errors

  • Stock unavailability

  • Suspected fraud or misuse

If payment has been taken for a cancelled order, it will be refunded.

8. Payment

Payments are processed via Shopify-supported payment providers. By placing an order, you authorize us and our payment providers to charge your selected payment method.

We do not store full payment card details.

9. Shipping & Delivery

Orders are processed and dispatched as soon as reasonably possible. Delivery times are estimates only and are not guaranteed.

Risk of loss:

  • B2C orders: risk passes upon delivery to you or your designated recipient, unless mandatory law provides otherwise.

  • B2B orders: risk may pass earlier, unless otherwise agreed in writing.

Failed delivery due to incorrect address, refusal, non-collection, or unpaid duties may result in additional costs borne by the customer.

Further details are set out in our Shipping Conditions. Lists of shipping issues or delays are explicit but not limited to the examples provided.

10. Right of Withdrawal & Returns

Positive Me applies a 14-day return and withdrawal period globally, in accordance with EU consumer law. Local laws may extend or modify this right.

Hygiene items (underwear, swimwear, socks) are excluded.

Returns are governed by our Returns & Refund Policy, which forms part of these Terms.

11. Refunds

Refunds are issued to the original payment method after inspection of returned items and within the timeframe required by applicable law and our Returns & Refund Policy.

12. Promotions & Discount Codes

Promotions and discount codes:

  • Are subject to stated conditions and validity periods

  • Have no cash value

  • May be limited to one per order

We reserve the right to cancel promotions or refuse misuse, including, but explicitly not limited to, using multiple codes, exploiting system errors, or reselling discounted items.

13. User Content (Reviews & UGC)

By submitting reviews, images, videos, or other content (“User Content”), you confirm you own or control the rights to such content.

You grant Positive Me a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, publish, adapt, and distribute such content for marketing and business purposes, including on the website, social media, advertising, email campaigns, and lookbooks.

14. Intellectual Property

All content on the Site (including trademarks, logos, text, images, and design) is owned by or licensed to Positive Me and is protected by applicable intellectual property laws. Unauthorized use is prohibited.

15. Acceptable Use

You must not:

  • Interfere with Site security or functionality

  • Attempt unauthorized access

  • Use the Site for unlawful, abusive, or fraudulent purposes

  • Upload or distribute harmful or infringing content

Examples of prohibited activity are explicit but not limited to the above.

16. Sustainability, Performance & Wellness Statements

Product descriptions and marketing statements describe design intent and user experience only. They do not constitute medical advice or guarantees of specific outcomes. Products are not medical devices.


17. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages, including loss of profits.

  • Our total liability related to any order is limited to the amount paid for the relevant product(s).

Nothing in these Terms limits liability that cannot be excluded under mandatory law.

18. B2B Orders

Consumer protections, including withdrawal rights, do not apply to B2B purchases, unless expressly agreed in writing. Separate commercial terms may apply.

19. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including carrier disruptions, customs delays, strikes, natural disasters, pandemics, or governmental actions. Lists of force majeure events are explicit but not limited to the examples provided.

20. Third-Party Services

The Site may include third-party tools or links (including Shopify services). We are not responsible for third-party content or practices.

21. Privacy

Personal data is processed in accordance with our Privacy Policy, which prevails in the event of conflict.

22. Changes to These Terms

We may update these Terms from time to time. Updates apply from the date posted and do not affect orders already accepted.

23. Governing Law & Jurisdiction

All disputes arising out of or in connection with these Terms shall be submitted to the courts of the Republic of Korea.
